General Terms and Conditions (GTC)
§ 1 Scope of Application
These General Terms and Conditions apply to all orders of artworks, limited editions, catalogs, sound carriers, and other goods placed via the website lovelab.berlin or the order channels linked therein (including the payment pages of the provider Stripe).
For services, exhibitions, use of space, events, productions, as well as photographic, cinematic, editorial, and other creative services, §§ 13 et seq. of these General Terms and Conditions shall apply complementarily.

§ 3 Conclusion of Contract
(1) The presentation of products on the website does not constitute a legally binding offer, but rather an invitation to order.
By clicking the purchase button on the payment page (»order with obligation to pay« or the corresponding label on the Stripe payment page), you are placing a binding order for the goods listed there.
(3) Confirmation of receipt of the order will be provided together with the acceptance of the order immediately after submission via automated email. The purchase agreement is concluded with this email confirmation.
The contract text is not stored separately; the order details will be sent to you by e-mail. The contract language is German.
§ 4 Prices and Shipping Costs
(1) All quoted product prices are final prices in Euros and include statutory VAT, where applicable.
Unless otherwise stated for the respective product, shipping costs are included in the price.
§ 5 Payment
Payment is made through the payment service provider Stripe (Stripe Payments Europe, Ltd., Ireland). The payment methods displayed on the payment page are available (e.g., credit card, Apple Pay, Google Pay). The purchase price is due immediately upon conclusion of the contract.
§ 6 Delivery
Delivery is from Berlin to the countries selectable on the payment page.
(2) Unless otherwise stated, delivery time within Germany is 3-7 working days, and 7-14 working days for international shipments. For limited editions with announced release dates, delivery will take place after the release date.
(3) All limited edition copies are numbered and signed; there is no entitlement to a specific number.
§ 7 Retention of Title
The goods remain the property of the seller until paid for in full.
§ 8 Right of Withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the Revocation Notice.
§ 9 Warranty
The statutory warranty rights apply. For artworks and hand-numbered editions, minor deviations due to production (e.g., in coloring or signature) are an expression of the artistic character and do not constitute a defect.
§ 10 Liability
The seller is liable without limitation for damages resulting from injury to life, body, or health, as well as for intentional acts and gross negligence. In cases of simple negligence, the seller is liable only for breaches of essential contractual obligations (cardinal obligations), limited to the contractually typical, foreseeable damage.
§ 11 Dispute Resolution
The seller is not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG).
§ 12 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law only applies to consumers to the extent that it does not deprive them of mandatory consumer protection provisions of the state in which the consumer has their habitual residence. Should individual provisions of these General Terms and Conditions be invalid, the contract shall remain valid in all other respects.
§ 13 Services and Other Services
(1) Sections 13 et seq. apply to services and other performances provided by Lovelab Dreamspace, in particular exhibitions, curation, use of space, events, public relations, photography, catalog production, film documentation, AI-supported film productions, and comparable creative and organizational services.
(2) The prices published on lovelab.berlin serve as a guide. The specific scope of services, date, price, and any additional costs shall be determined by the individual quote, calculation, or order confirmation.
(3) A service contract is concluded through the acceptance of an offer or an individual calculation by the client and its confirmation by Lovelab.
§ 14 Prices and additional costs for services
(1) All prices for services mentioned on the benefits page are net plus statutory VAT.
(2) Costs that are explicitly stated as not included will be charged additionally. This applies in particular to printing costs for flyers and catalogues raisonnés. Printing costs are calculated and billed based on the prices of the respective printing company valid at the time the order is placed.
(3) For services whose scope cannot be definitively determined at the time of commissioning, the anticipated scope will be specified in the quote or the cost estimate. Additional services or a substantial increase in effort fundamentally require prior coordination with the client.
(4) Costs for drinks at events are not charged at a flat rate per guest. Drinks are offered at the respective current retail prices at the bar. Insofar as bar staff or a flat-rate fee for glassware and dishwashing are commissioned, the prices agreed upon for this shall apply.
§ 15 Payment for Services
Unless otherwise agreed in the individual quotation, 50 % of the agreed fee is due upon placement of the order and the remaining 50 % upon delivery or completion of the agreed service.
(2) Payment in installments can be arranged individually.
(3) For services that require pre-financing or the commissioning of external service providers, a different payment arrangement may be agreed upon.
§ 16 Exhibitions and Events
For exhibitions and events, the agreed period is specified in the quote or order confirmation.
(2) The exhibition in the Lovelab Dreamspace is a production and presentation service and not merely the provision of premises, unless the respective offer explicitly stipulates exclusively a room rental.
(3) In the case of room rentals, the client is responsible for adhering to the agreed-upon duration of use and for the behavior of their guests and any persons commissioned by them.
(4) The client must handle the rooms, equipment, and provided items with care. Damages caused by the client, their guests, or persons commissioned by them must be reimbursed by the client insofar as they are responsible for the damage.
(5) The complimentary basic equipment exclusively comprises the equipment explicitly stated on the service specifications or in the quotation. Further technical services, additional personnel, or special technical requirements may be charged separately.
§ 17 Sales and Referral Commissions
For sales of works of art as part of an exhibition managed by Lovelab, the commission fee stated in the respective offer applies.
(2) Unless otherwise agreed in the offer, the placement commission is 30 % in the Culture tariff and 20 % in the Commercial tariff.
(3) If the issuer brings the buyer themselves, the placement commission is 15 %, provided the sale is processed through the exhibition or through Lovelab.
(4) Proprietary sales outside the exhibition are commission-free, provided they are not brokered or processed via Lovelab.
§ 18 Photo, Film and Production Services
(1) The specific scope of photo, film, and other production services results from the respective offer.
(2) Raw material from photo, film, and sound recordings is fundamentally not part of the agreed service and will not be handed over, unless explicitly agreed otherwise.
(3) The rights of use agreed upon in the respective offer determine the scope of use of the finished material. Unless otherwise agreed, the agreed rights of use include applications, the own website, and own social media channels. Any further commercial use requires a separate agreement.
(4) Insofar as recordings of events show persons from the audience, the production takes place in compliance with the respective applicable statutory provisions on data protection and personal rights. The client shall support Lovelab in organizing and communicating the notices and consents required for the event.
§ 19 AI-supported productions
(1) In AI-supported film and image productions, Lovelab owes the creative and technical production services described in the respective offer. AI systems are used as production tools in this process.
(2) Due to the technical characteristics of generative systems, it cannot be guaranteed that individual generated results will correspond in every respect to a specific reference image, a specific person, a specific style, or a specific technical characteristic.
(3) Changes, additional scenes, additional production steps, or further rounds of revisions that go beyond the scope agreed upon in the quote may be charged separately.
§ 20 Catalogs, Printed Matter and Publications
(1) For catalogs and printed matter, the agreed price generally includes design, typesetting, and prepress preparation to the extent offered in each case. Printing costs are not included, provided this is expressly stated in the offer or on the service page.
(2) Printing costs are calculated based on the print run, format, paper, and the printer's prices valid at the time of the order.
(3) The PDF version of a printed catalogue raisonné is part of the respective catalogue scope offered, unless otherwise agreed in the offer.
§ 21 Cancellation and Rescheduling
If a commissioned exhibition, event, or production is canceled or postponed by the client, services already rendered as well as third-party costs already incurred and no longer cancellable must be reimbursed.
(2) Further cancellation terms may be agreed upon in the individual offer, particularly in the case of events, exhibitions, and productions involving significant preparatory effort.
(3) Rescheduling requires coordination and may lead to additional costs if already booked resources, external service providers, or production times are affected.
§ 22 Right of withdrawal for services
Insofar as a consumer concludes a distance contract for services or a contract away from business premises, the statutory provisions on the right of withdrawal shall apply. Insofar as Lovelab begins providing the service at the express request of the consumer before the expiry of an existing withdrawal period, the declarations and information required by law for this purpose shall be obtained or provided separately.
§ 23 Liability for Services
The statutory liability provisions apply to services. Lovelab shall have unlimited liability for damages resulting from injury to life, body, or health, as well as in cases of intent and gross negligence. In cases of simple negligence, Lovelab shall only be liable for the breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable contractual damage.
Liability for damage to items brought in by the client is excluded, unless Lovelab has caused the damage intentionally or through gross negligence. Mandatory statutory liability remains unaffected.
§ 24 Dispute Resolution for Services
Lovelab is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG).
§ 25 Final provisions for services
In addition, sections 1 to 12 of these General Terms and Conditions shall apply accordingly, insofar as their content is applicable to services and other performances.
German law applies. With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
